2. Marriage Out of Community of Property Without Accrual

This regime requires an antenuptial contract (ANC) to be signed before the marriage.

• What you bring into the marriage and acquire during the marriage remains yours.
• Each spouse is responsible for their own debts.

3. Marriage Out of Community of Property With Accrual

This is often considered the most balanced regime and also requires an antenuptial contract.

Under this regime:

• Each spouse retains their own estate during the marriage.
• At the end of the marriage (by divorce or death), the growth of both estates during the marriage is taken in to account and the growth is shared between the spouses.
• Assets excluded in the ANC are not shared.
