THIS PRIVACY POLICY (“POLICY”) GOVERNS THE COLLECTION, MANAGEMENT AND DISCLOSURE OF PERSONAL INFORMATION THAT HENGST & MCMASTER (“HM”) COLLECTS. THIS PRIVACY POLICY MEETS THE REQUIREMENTS OF NOTIFICATION AND COLLECTION AS PER THE PROTECTION OF PERSONAL INFORMATION ACT, 2013

1.1 By instructing and mandating HM to provide legal services, the client consents to HM collecting, receipting, recording, storing, retrieving, transmitting, distributing and/or making available in any other form the personal information.
1.2 The client consents to HM retaining client’s personal information upon termination of the mandate and/or services.
1.3 The client’s personal information will not be shared, sold, rented or disclosed other than as described in this Privacy Policy.
1.4 In the event that the client elects to revoke his/her/it’s consent pertaining the personal information and would like HM to remove and/or delete the personal information entirely, the client is requested to send a email to : admin@hmattorneys.co.za.
2.1 HM will collect the following types of personal information:
2.1.1 Name and Surname;
2.1.2 Identity Number;
2.1.3 Age;
2.1.4 Telephonic contact details;
2.1.5 Email addresses;
2.1.6 Residential Address;
2.1.7 Employment Address and Employment details;
2.1.8 Salary details;
2.1.9 Identity Document;
2.1.10 Bank Statements;
2.1.11 Income and expenses;
2.1.12 Bank Account details;
2.1.13 Income Tax numbers;
2.2 HM will retain the personal information for a period that is longer than is required by law and client consents to such retention.
3.1 HM may disclose the client’s personal information to:
3.1.1 HM employees to enable HM to provide a service as mandated;
3.1.2 suppliers and other third parties with whom HM have commercial relationships, for business and related purposes; and/or
3.1.3 any organisation for any authorised purpose.
3.2 The client’s personal information will be used to provide the client with the requested services; to process transactions on behalf of the client; to engage in electronic communications and transactions with the client; to update HM’s records and keep client’s contact details up to date.
3.3 HM may share the client’s personal information with authorised third parties persons such as employees and service providers of HM. HM does not permit these parties to use such information for any other purpose than to perform the services that HM has been instructed by the client to provide.
4.1 HM will take all reasonable measures in order to ensure the client’s personal information is appropriately safeguarded, these precautions include, but are not limited to: the use of a sufficiently secure server, firewalls, passwords and encryptions.
4.2 Should an unauthorised person/s gain access to the client’s personal information, HM will contact the client within a reasonable time to inform the client of the security breach.
4.3 HM cannot provide any assurance regarding the security of transmission of information to the client and cannot guarantee that the information the client supplies will not be intercepted while being transmitted over the internet. Accordingly, any personal information or other information which the client transmits is transmitted at client’s own risk.
4.4 HM has placed security safeguards to protect the client’s personal information through agreements concluded with third party service providers and employees. HM will not be held liable for any illegal activity or other activity that may result in a claim for damages due to lack of protection of your personal information whilst under the care of the third party.
5.1 Should the client have any questions about this Privacy Policy, or require a correction to be made to client’s personal information that HM keeps on record, or should the client feel that the he/she would like to object to the collection, use or processing of client’s personal information or that the client would like us to delete the personally identifiable information, then client is kindly requested to send an e-mail to admin@hmattorneys.co.za, requesting same. HM will endeavour to make the correction and provide the client with the record in accordance with client’s request.
5.2 We will treat the client’s requests or complaint confidentially.
