The first thing we usually do is send a letter of demand. This is a formal letter we write and send to the person who owes you money. It tells them how much they owe, what it’s for, time period to pay it by and consequence to follow if payment is not made, ie legal action. Like in life and required in law, everyone deserves a second chance to remedy their wrong, before going for the jugular (ie legal action).
It might sound simple, but it’s a powerful tool. Sometimes, all it takes is a letter and a “friendly” phone call from a lawyer to make someone realise you’re serious. Many debts get paid at this stage, without going to court at all.
If the person still refuses to pay, we proceed with legal action. This starts with something called a summons. A legal document that tells the debtor you’re officially suing them for the money.
The summons includes details like how much they owe and why, and it gives them a deadline to respond. If they ignore it or don’t respond in time, we can ask the court to give you a default judgment.
Important tip: Don’t wait too long, if no action is taken (3 years from date money due) your legal claim prescribes.
